This Privacy Policy is governed by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). By using the App, you consent to the practices described in this Privacy Policy.

2.1 Information You Provide

We collect personal information you provide directly, including:

  • name and email address (at registration);
  • date of birth or age confirmation;
  • fitness goals, current fitness level, and health information provided during onboarding;
  • workout data, activity records, and performance information;
  • photographs and other content submitted to the App; and
  • communications you send to us.

2.2 Information Collected Automatically

When you use the App, we may automatically collect:

  • device type, operating system, and unique device identifiers;
  • usage data including features accessed, time spent, and actions taken within the App; and
  • crash reports and performance data.

2.3 Payment Information

TCC does not collect or store payment card details. All subscription payments are processed by Apple or Google through their respective in-app purchase platforms. Please refer to Apple’s or Google’s privacy policies for information about their data practices.

 

3. How We Use Your Information

We use your personal information to:

  • create and manage your account;
  • generate personalised AI workout programs based on your onboarding information;
  • operate the App and deliver its features, including the activity feed, leaderboard, and steal-a-workout functionality;
  • communicate with you about your account, subscription, and any updates to the App or these policies;
  • improve the App through analytics and usage data;
  • enforce our Terms and Conditions and protect against misuse; and
  • comply with our legal obligations.

 

4. Health Information

You may provide health-related information (such as fitness level, injuries, or goals) during onboarding to enable AI-generated workout programs. This information is treated as sensitive information under the Privacy Act 1988 (Cth). We collect this information only with your consent and use it solely to personalise your in-App experience. We do not sell or share your health information with third parties for marketing purposes.

 

5. Disclosure of Your Information

We do not sell your personal information. We may disclose your information to:

  • third-party service providers who assist us in operating the App (such as cloud hosting and analytics providers), who are bound by confidentiality obligations;
  • Apple or Google in connection with subscription and billing services;
  • law enforcement or regulatory authorities where required by law; and
  • a successor entity in the event of a merger, acquisition, or sale of our business.

We may also collect, analyse, and share anonymised and aggregated data derived from user activity on the App (such as workout trends, exercise popularity, training patterns, and usage statistics) with third parties including commercial partners, researchers, and advertisers. This data does not identify you personally and cannot reasonably be used to identify any individual user. By using the App, you consent to TCC collecting and commercialising anonymised and aggregated insights in this manner.

6. User Content and Public Features

Certain information you submit, including your username, workout activity, and leaderboard data, may be visible to other users of the App or to the general public. Please be mindful of the information you share within the App.

 

7. Data Security

We implement reasonable technical and organisational measures to protect your personal information from unauthorised access, loss, or misuse. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

In the event of a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme.

 

8. Data Retention and Deletion

We retain your personal information for as long as your account is active or as required to fulfil the purposes set out in this Privacy Policy. If you delete your account, we will delete your personal information from our systems, subject to any legal obligations that require us to retain certain records.

Under the Australian Privacy Principles, you have the right to:

  • access the personal information we hold about you;
  • request correction of inaccurate or incomplete information; and

10. Cookies and Tracking

The App may use analytics tools to collect usage data. This data is used in aggregate form to improve the App and is not used to identify you individually. We do not use third-party advertising trackers within the App.

 

11. Children’s Privacy

The App is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have collected information from a person under 18, we will take steps to delete that information promptly.

 

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated Policy within the App or by other reasonable means. Continued use of the App after any changes constitutes your acceptance of the revised Policy.
